Exclusions:

This Privacy Policy shall not apply to any unsolicited information (such as comments and feedback) you provide to the Company through the Website and/or that you post to any public areas of the Website, such as comments and discussion boards (collectively, “Unsolicited Information”). All such Unsolicited Information shall be deemed to be non-confidential and the Company shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution. You should be aware that if you voluntarily disclose Unsolicited Information online, that Unsolicited Information can be collected and used by others. For example, if you post your email address in comments sections or online forums, you may receive unsolicited messages from others. The Company has no control over the use of Personally Identifiable Information that you voluntarily post in public forums.

The Company reserves the right, in its sole discretion, to reject, refuse to post or remove any posting or communication (including email) by you, or to restrict, suspend, or terminate your access to all or any part of the Website at any time, for any or no reason, with or without prior notice, and without liability.

Photophlow Rooms, Room Activity History, and Staff Access:

One of Photophlow's features is conversation logging within public and/or private chat rooms. (the “Room”) There are two types of Rooms: (1) a “User Room” which corresponds to each individual User and (1) a “Group Room” that corresponds to any pre-existing group of Users on a third party website group. By default all Rooms are locked and will not allow any other Users access permissions to enter the Room. For a User Room, the User must click an unlock link to enable the room and set access permissions. For a Group Room, the administrator of the corresponding third party website group must click an unlock link to enable the room and set access permissions. Any User that controls which other Users may have access to any Room by setting up access permissions shall be referred to as a “Room Administrator.”

As you contribute to a conversation, a record is made so that you may revisit your past conversations at a later time and so that if you are accidentally logged out, you can rejoin and pick up where you left off. (the “Room Activity History”) The Room Activity History is the responsibility of a Room Administrator. A Room Administrator has the ability to enable or disable the ability to view Room Activity History for that particular Room.

The Room Activity History will have the same access permissions as the Room itself. For example, a Room set to allow entrance to specific Users of a group (the “Group Members”) only will only allow Groups Members access to the Room Activity History. A Room Administrator controls which Users may have access to the Room and Room Activity History, provided that Photophlow.com staff retain the right to view Room Activity History and contact information for the purposes of resolving technical issues and addressing Terms of Service abuse allegations.

You should be aware that if you voluntarily disclose Unsolicited Information in a Room, that Unsolicited Information can be collected and used by other Users that have access to the Room. For example, if you post your email address in comments sections, you may receive unsolicited messages from others. The Company has no control over the use of Personally Identifiable Information that you voluntarily post in public or private forums.
